No fine print — the essentials in brief

  • PixiProof is an online platform for private galleries and proofing; you pay for galleries on a pay-per-gallery model (details and prices — in the Terms and on the site).
  • Your photos and rights to them remain yours. PixiProof does not become the owner of or acquire economic copyrights to uploaded content.
  • You grant us only a limited licence so the Service can work: storage, technical processing (e.g. thumbnails, preview variants, watermark if you enable it), and showing content to people you choose to share the gallery with.
  • Without your separate, explicit consent we do not use Gallery content to advertise PixiProof, sell licences to third parties, or train AI models.
  • You are responsible for having the right to share photos and — where needed — consents of people depicted.
  • Access on our side to files is limited to what is needed to maintain, secure, support, and comply with the law — we do not run a public gallery of your work.
  • Payments, Wallet, complaints, and Terms changes are described in more detail in the full text below.
  • The Wallet is used for fees in PixiProof. After deleting your account you may submit a request by email for a refund of unused balance — we review it individually; details in § 6.3 below.

1. General provisions

1.1. The Service Provider is TBA, conducting business under PixiProof, Tax ID N/A, address: N/A, email: support@pixiproof.com (the "Service Provider"; Service brand: "PixiProof").

1.2. PixiProof is an online Service that enables photographers to create private galleries, share them with clients, collect selections, and deliver digital files.

1.3. By using the Service, you agree to these Terms and the Privacy Policy.

1.4. These Terms apply to both business users and consumers. Consumer rights under mandatory local law are not limited by these Terms. If there is a conflict between these Terms and non-waivable statutory rights, statutory rights prevail to the extent of that conflict.

2. Definitions

  • Account - a photographer user account in PixiProof.
  • Gallery - a private online space created by the photographer to store and share media.
  • Client - a person invited by the photographer to access a gallery.
  • User Content - photos, videos, metadata, and related materials uploaded or generated by users in connection with galleries.
  • Package - a storage and feature plan available for gallery publishing.
  • Fees - charges for paid Service features, including gallery publication, package upgrades, and other paid actions shown in-app.
  • Wallet - an in-app balance used to pay fees in the Service.
  • Top-up - adding funds to the Wallet.

3. Registration and account rules

3.1. Registration is optional but required for photographer dashboard features.

3.2. You must provide accurate and up-to-date account information.

3.3. You are responsible for protecting account credentials and all actions under your account.

3.4. We may suspend or terminate accounts that violate these Terms, applicable law, or Service security requirements.

4. Galleries, content and photographer rights

4.1. After paying required fees (direct payment or Wallet funds), you may create and manage galleries according to selected limits and features.

4.2. Storage limits and pricing are displayed in the Service interface and may vary by package and region.

4.3. You retain ownership and intellectual property rights to your uploaded content. You grant PixiProof a limited, non-exclusive, worldwide licence only to host, process, display and deliver content as needed to operate, secure and improve the Service. This licence ends when content is deleted from active systems, subject to backup, legal retention and technical deletion cycles.

4.4. Without your separate explicit consent, PixiProof does not use your gallery content for external advertising, third-party content licensing, or training publicly available AI models.

4.5. You are solely responsible for ensuring you have all rights, permissions and legal bases required to upload and share your content (including rights related to depicted persons).

4.6. Original and delivered file handling, deletion timing and availability are defined by product settings and workflow states visible in the Service. You are responsible for maintaining independent backups of original materials outside the Service where required by your workflow.

5. Client gallery access

5.1. Gallery access may be protected by passwords, private links or both, depending on your settings.

5.2. Clients can view, select or download content only within permissions granted by the photographer.

5.3. PixiProof is not a party to separate commercial agreements between photographers and their clients.

6. Fees, payments and wallet

6.1. Service Fees are shown in-app before checkout and are charged in advance unless explicitly stated otherwise.

6.2. Available payment methods depend on your region and payment provider availability.

6.3. Wallet funds are intended for use within PixiProof. During active use of the account, Wallet funds are generally non-cashable and non-transferable between user accounts.

6.4. After account deletion, you may submit an email request for review of unused Wallet balance refund eligibility. Requests are reviewed individually based on account history, fraud checks, legal requirements and technical feasibility; approval is not automatic and may be declined where lawful and justified.

6.5. Invoices or billing confirmations are delivered electronically when required by law or billing setup.

7. Consumer withdrawal and cancellation rights

7.1. If you are a consumer, statutory withdrawal rights for distance contracts apply where mandatory law grants them.

7.2. Where digital services are fully performed with your prior express consent before withdrawal expiry, withdrawal rights may be limited as allowed by law.

8. Complaints and support

8.1. Service complaints can be sent to support@pixiproof.com with sufficient details to identify your Account and the issue.

8.2. We handle complaints within a reasonable timeframe, typically not exceeding 14 days unless complexity requires more time.

9. Availability and liability

9.1. We strive for high availability but do not guarantee uninterrupted operation at all times.

9.2. Planned maintenance may temporarily reduce availability. We will provide notice where reasonably possible.

9.3. To the maximum extent permitted by law, our liability for indirect, incidental, special, consequential, exemplary or punitive losses, including loss of profits, goodwill, business opportunity or data, is excluded.

9.4. To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the higher of: (a) PLN 500 gross, and (b) the total Fees paid by you in the 12 months preceding the event giving rise to liability.

9.5. Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law, including applicable consumer protections.

10. Governing law and disputes

10.1. These Terms are governed by the laws of Poland, without prejudice to mandatory consumer protections in your country of habitual residence.

10.2. Disputes are handled by competent courts under applicable procedural law, and consumers may have access to out-of-court dispute mechanisms where available, including the EU ODR platform at ec.europa.eu/odr where applicable.

11. Changes to the terms and final provisions

11.1. These Terms take effect on 02.02.2026.

11.2. We may update these Terms for legal, security, operational or product reasons. Material changes are communicated in advance where required.

11.3. Continued use of the Service after the effective date of updated Terms constitutes acceptance, unless mandatory law requires a different mechanism.

11.4. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect to the extent permitted by law.

Legal note: These Terms and the Privacy Policy together govern your use of the Service. If mandatory local law grants stronger user rights, those mandatory provisions prevail.
